New Laws Enacted!

Three new laws have recently taken effect that make it easier for patients to qualify for New Hampshire’s Therapeutic Cannabis Program (TCP). The program’s written certification form has been updated to reflect these changes.

Qualifying Conditions Expanded

HB 1349 added generalized anxiety disorder as a qualifying condition. Additionally, HB 1278 authorized N.H. medical providers to certify adults (21+) for “any debilitating condition or symptom.” To certify a patient with an unlisted condition or symptom, the provider must attest to their clinical opinion that the benefits are likely to outweigh the risks for that patient.

These changes will allow more Granite Staters to benefit from the TCP!

Visiting Patients No Longer Limited

Another positive change associated with HB 1278 impacts visiting patients. Previously, patients visiting from another U.S. state or Canada could only purchase from a N.H. dispensary up to three times in a year unless they produced documentation of their qualifying condition. Now that HB 1278 is in effect, this is no longer required. Visiting patients with valid certifications for therapeutic cannabis from another state or province can now make purchases without worrying about their number of visits.

More Providers Authorized to Certify

SB 357 allows additional N.H. medical providers to certify patients. This is important because many patients have struggled to find a provider who is knowledgeable about therapeutic cannabis. Also, some providers are unwilling or unable to certify patients because they work for a hospital or medical group that does not support therapeutic cannabis.

The new law allows certifications by any N.H. medical provider who can prescribe drugs to humans. The updated written certification form includes the following new provider types:

  • Dentists
  • Podiatrists
  • Optometrists
  • Naturopathic doctors

Previously, only doctors, advanced practice registered nurses (APRNs), and physician assistants could certify patients for therapeutic cannabis.
